A shocking crime is unfolding in Fresno County, California. The District Attorney Lisa Smittcamp announced that Kenneth Johnson, 30, told police during a three-hour interview that he punched the baby, José Luis Espinosa, because he was frustrated with José’s crying. Kenneth is the boyfrieind of the 20-year-old, nanny, charged with caring for baby Jose.
Jose was found dead shortly after Kenneth allegedly punched him.
But here's the strange part, despite Johnson’s confession, and despite damning security camera footage, prosecutors will not be filing charges against him. Because there were no visible bruises on the toddler’s body, prosecutors are unable to connect Kenneth Johnson to any physical evidence.
Local station KFSN reports that authorities are “confident” Johnson is the murderer, but due to lack of evidence, they cannot indict him. Detectives working the case have not been asked to submit any further evidence.
