R&B singer Kevin McCall is suing Real Housewives of Atlanta star Eva Marcille for custody of their daughter.

Kevin and Eva share a 5-year-old daughter, Marley Rae but Kevin claims that he hasn't seen or had any contact with his daughter for over a year.

For the last couple of years, Eva has been claiming that their daughter shouldn't have contact with Kevin.

Now Kevin's taking her to court. MTO News confirmed that Kevin McCall’s attorney, Admamma Mckinnon, filed legal documents alleging that Eva deliberately kept him away from their child since she moved to Atlanta in 2015.

Kevin, who became famous for collaborating on music with Chris Brown, also wants the court to change Marley's name -  back to his last name. Eva Marcille who recently married changed Marley’s last name to that of her new husband – Sterling. 

Eva who first gained national prominence by starring on “America’s Next Top Model,” explained her rationale for the name change. She said that she didn’t want her daughter to feel alienated, considering that she and the rest of their household would have her husband's last name.

Eva currently has a toddler with her husband, Michael, whose last name is Sterling. Eva is also expecting another baby boy with her husband whose name will also be Sterling. Eva wants Marley along with her siblings to have the same last name.
