The lawyers for Empire actor Jussie Smollet are pushing for the Osundairo case aginst the actor to be dismissed.

According to TMZ, attorney Mark Geragos filed legal docs asking a judge to toss the Osundairo Bros.' defamation lawsuit against him, one of his colleagues and his firm, which they filed in April.

Following the dismissal of all of Smollett's disorderly conduct indictments for his alleged hate crime hoax, his lawyers also filed motions claiming that because the actor was the victim of an attack earlier this year in Chicago, a judge should reverse his decision to appoint a special prosecutor.

"Not only have the media and the public failed to critically look at the evidence (and lack thereof) against Mr. Smollett, but now, (Toomin) has accepted false media reports to presume Mr. Smollett guilty of charges which he pled not guilty to and which were dismissed against him," the motion states.

A special prosecutor has been brought in to review the case, which could see Smollett re-charged over the alleged staged attack.
