Hollywood actress Gabrielle Union may be suing America's Got Talent creator Simon Cowell for allegedly smoking on set.

An insider told The Mail that Union feels that Cowell endangered her life by smoking near her. According to the source, Union feels that because smoking can cause cancer, she should not be forced to intake second-hand smoke in the workplace.

Gabrielle was released from the show after complaining about several racial insensitivities she experienced while on set, including Jay Leno making a racist joke aimed at the Asian community. Several celebrities have stepped forward to defend the actress and have blasted the show's producers as well as creator, Simon Cowell, but not Klum. Terry Crews also faced scrutiny after he issued a statement, praising the show.

He later issued an apology to Union via Twitter:

Terry wrote: "I want you to know it was never my intention to invalidate your experience — but that is what I did. I apologize. You have been through a lot in this business, and with that, I empathize with the struggle toward fairness and equality in the workplace."
