Yesterday R&B singer Ciara and her baby father Future were in a California court - doing battle over custody. Ciara tried to get sole custody of baby Future. Here is how TMZ is reporting it:
Sources connected to the former couple say Ciara showed up in court asking for sole custody of their 1-year-old son, baby Future. She claimed Future was a bad parent who was not present in the child's life. We're told she and her lawyer also trash talked Future to the judge, saying he was a bad person.
For his part, Future showed up and asked for joint custody, and the judge was squarely on his side, rejecting her arguments.
California courts favor joint custody, so the decision was in line with the law.
Ciara still has a defamation lawsuit. Ciara sued Future claiming that he slandered her, by calling her a "b*tch", and suggesting that he paid her $15K a month in child support - which she claims is false.
In Georgia, in order to prove defamation Ciara has to show:
- a false statement about the Future;
- communication of the statement to a third party in the absence of a special privilege to do so;
- fault of Future amounting at least to negligence; and
- harm to Ciara, unless the statement amounts to per se defamation. See Smith v. Stewart, 660 S.E.2d 822, 828 (Ga. Ct. App. 2008).
Well it looks like she may have met her burden. Someone saw them in the courthouse yesterday, and Future was looking REAL STRESSED. Ciara, and her team of lawyers, was looking as confident as ever.
