90 Day Fiancé: Happily Ever After star Jay Smith was arrested this week, and taken into the the custody of U.S. Immigration and Customs Enforcement. MTO News has confirmed.

And Jay, who is a native of Jamaica, is expected to be deported out of the United States.

Jay Smith is currently in the midst of a divorce from his reality star wife Ashley Martson. And according to a new report, it was ASHLEY that's getting him deported.

US Weekly is reporting that Ashley called the police and ICE on Jay, after the two had a blow up fight on Monday.

Shortly after Ashley's call, police issued a warrant out on Jay - and sent ICE agents out looking for the reality star.

Jay turned himself in to authorities yesterday, after he learned that he had a warrant out for his arrest.

The warrant came from an alleged violation of a protection from abuse order that Ashley, 31, placed against Jay on Monday, July 1

Before surrendering to ICE custody, Smith posted a cryptic video on his Instagram Stories of himself listening to a song about someone “turning” themselves in.

Smith moved from his native country to Martson’s hometown of Mechanicsburg, Pennsylvania, in 2018 after they met and fell in love. He legally entered America under a K-1 visa, which requires a foreigner to marry his or her U.S. citizen petitioner within 90 days of entry; otherwise, they have to depart the country.

The couple tied the knot in May 2018, which fell within the 90-day-period, but Martson never filed to adjust Smith’s status.

Jay is currently being detained at York County Prison in Pennsylvania. Under US immigration law, and President Trump's new policy, he'll likely be deported in a few weeks.
